Scotland Notice to Raise Proceedings for Possession

Scottish landlords, before you can retake possession of a tenant's unit, you must serve the tenant with this Form AT 6, Notice Under Section 19 of Intention to Raise Proceedings for Possession.

The Notice is for assured tenancies, under Section 19 of the Housing (Scotland) Act 1988, and is for use only by landlords. The Notice informs the tenant that you intend to apply to the Sheriff for an Order of Possession of the rental premises. Before you may gain possession of the property, you must serve on the tenant (i) a Notice to Quit, then (ii) serve this notice, and then (iii) obtain an Order for possession from the courts.
