Are you serving a legal document by fax in the Province of Alberta? You will need to prove that the document was served by swearing an Affidavit of Service by Fax Transmission.

Documents can only be served by facsimile (fax) transmission if allowed by the court, or if fax transmission is deemed to be good service pursuant to the terms of the contract under which the document is being served. Be sure to verify whether fax service is allowed before you attempt to serve by fax.
