Ontario Cohabitation Agreement for Same Sex Couple
Prepare a Cohabitation Agreement for a same sex couple who are planning to live together with this template contract form for Ontario.
- The Agreement establishes what each partner owns going into the living arrangement, and set out the responsibilities of the parties with respect to housing and maintenance costs.
- Any property and assets owned by one of the partners prior to the cohabitation belongs to that partner.
- All property acquired during the relationship will be considered joint property unless the partners specify otherwise in writing, and will be divided equally between them if they separate.
- If the partners own a residence as tenants in common, each of them have a life estate in the property for as long as they reside in the property.
- Each partner is responsible for his/her own debts and obligations.
- The partners will be jointly responsible for raising, supporting and caring for any children of the relationship.
- Each party waives any right to claim part of any inheritance left to the other party.
