USA Estoppel Affidavit of Mortgagor

If you are selling a real estate property in the US which has a mortgage registered against title, the purchaser may require you to provide an Estoppel Affidavit of Mortgagor.

The Affidavit sets out the current status of the mortgage including:

• Details of the registration of the mortgage and promissory note securing the loan,
• Remaining balance to be paid under the mortgage,
• Affiant has insured the property continuously,
• Property tax has been paid to date,
• There are no existing liens against the property.
