Any entity that furnishes labor and/or materials for the construction, alteration or repair of a structure on, or for the improvement of, real property are entitled to mechanics lien protection. This includes general contractors, subcontractors, laborers, design professionals, landscapers (for services over $5,000) surveyors and equipment lessors. Contractors must be licensed or registered if required by law, in order to file a lien.
Lien claims must be filed no later than 90 days after the last day the claimant furnished labor or materials to the project.South Carolina laws allow an extension of this time period for warranty work, with the 90-day period starting on the date the warranty work is done.
