    Who has the right to file a mechanics lien under Hawaii lien laws?

    General contractors, subcontractors and sub-subcontractors, suppliers, laborers, architects, engineers and design professionals are entitled to file a lien, however, the architect's or design professional's work must be incorporated into the project for lien rights to attach. If State law requires a party to be licensed in order to do business in Hawaii, any unlicensed party will not have lien rights.

    What is the deadline for filing a lien?

    A mechanics lien must be filed within 45 days of the completion of the improvements. If a Notice of Completion is filed, the filing date is used as the completion date of the project for purposes of calculating the 45-day period. If no Notice of Completion is filed, the improvement will be considered complete one year after the substantial completion of the project.
