Consent of Landlord

Your original lease agreement will likely require the landlord to consent in writing to the sublease. This sublease template contains a Consent Form to be signed by the landlord.

Subtenant's Duties and Responsibilities

  • The subtenant must pay the rent, the utilities and a damage deposit. The sublease form allows you to decide whether these amounts are to be paid to the original tenant (who will then pay the landlord), or directly to the landlord.
  • The subtenant must keep the premises in clean and good condition.
  • The subtenant is also responsible for meeting all of the obligations of the original tenant under the head lease.

Assignment

The subtenant cannot assign the sublease without the consent of both the landlord and the original tenant.

It is important to remember that a sublease is NOT an assignment. The original tenant is still responsible for ensuring performance of all of the obligations under the head lease until the expiration of the term.

Other Items Included with the Sublease

  • The sublease includes a Premises Inspection Report and Inventory Checklist. This checklist should be completed by the parties before move-in and after move-out, to determine the cost of any damage to be deducted from the security deposit. 
  • The file also includes a Co-Signer Agreement to be used in the event that the subtenant is a minor (such as a student). This form would be signed by a parent or guardian, who guarantees to pay any amounts due if the tenant fails to pay.
