Who has the right to file a mechanic's lien in New Mexico?

Anyone who performs labor or supplies equipment, tools, machinery or design services for a construction project has a mechanic's lien right. This includes architects, design professionals, surveyors and engineers. Suppliers to suppliers are not entitled to claim a lien. If a license is required, the claimant must be licensed.

What is the deadline for filing a lien?

Any claimants who contracted directly with the property owner must file a lien within 120 calendar days after the date of completion. Claimants who did not contract directly with the owner have 90 calendar days after completion to file their lien. It is not required by law to serve a copy of the lien on the property owner.
