Different Types of Power of Attorney

California law recognizes four (4) types of power of attorney - General, Limited, Durable, and Medical.

  • general POA gives your agent broad and sweeping authority to manage your financial and business affairs. A General POA does not remain effective if you become incapacitated.

  • limited POA is used for a specific purpose, for example a purchase or sale of real estate where you would give the agent the ability to sign documents and take actions to complete the transaction in your absence. This type of POA is for a specified purpose and only remains in effect until the purpose is accomplished.

  • durable (or springing) POA becomes effective upon signing and remains in effect even if you become incapacitated.

  • medical POA appoints a healthcare agent to make healthcare decisions for you, based on your wishes, and can include life-prolonging decisions. A medical POA remains in effect until you revoke or replace it, or until your death.

Statutory Requirements for Signing

Powers of attorney in California must be signed in front of either a notary public or, alternatively, two adult witnesses who are not related to you by blood, marriage, or adoption. The agent you appoint in your POA cannot act as a witness.

California powers of attorney must be properly signed and witnessed in order to be legally valid.

Authority to Make Decisions

You determine how much authority your agent will have. You can grant them broad powers of authority or you can put limits on their authority. The choice is always yours. And as long as you retain capacity, you have the right to make your own decisions, even if there is a power of attorney in place.

California Revocation of Power of Attorney
