Q. What laws are in place in WA to protect the rights of landlords and tenants?

A.  The rights and obligations of tenants and landlords in Western Australia are set out in the Residential Tenancies Act 1987. The Act applies to any residential tenancy agreement entered into, renewed, extended, assigned or otherwise transferred after the commencement of the Act.

The ct does NOT apply to:

  • Strata leases
  • Occupancy agreements pursuant to a purchase and sale of the property or arising under a mortgage
  • Premises which are owned by a company and are let to persons who have a controlling interest
  • Agreements for roomers or lodgers
  • Student accommodation in an educational institution
  • Hotels, motels, or other holiday accommodation
  • Hospitals, nursing homes, and residential care homes
  • Premises used for the purposes of a club


Q. Does the tenancy agreement need to be in writing?

A.  The rental agreement is a prescribed form (Form 1AA), which cannot be altered. However, the parties can add additional clauses provided that they are not in breach of the Act. However, if the residential tenancy agreement is oral rather than written, tenants and lessors still have to comply with the Residential Tenancies Act 1987.

Q. What other documents must a landlord provide to a tenant at the start of the tenancy?

A. At the start of the tenancy, the landlord must give the tenant:

  • A copy of either Form 1AC (for written agreements) or 1AD (for verbal agreements)
  • A copy of the residential tenancy agreement (if written)
  • Two copies of the property condition report (within 7 days of move-in)
  • Receipt for payment of bond (if applicable)
  • Keys or access cards / codes
