Builders, subtrades, suppliers, engineers and architects can file a lien under the British Columbia Builders Lien Act for work, materials, or equipment supplied for improvements (construction, repairs or renovations) to real property.

If, after filing your lien claim, you still have not received payment from the owner or general contractor, you have 1 year from the date you filed the lien to start a lawsuit in BC Supreme Court to enforce the lien. You must also file a certificate of pending litigation in the Land Titles Office at the time you commence the lawsuit. If you fail to do either of these things within that 1-year period, your lien is no longer enforceable.

British Columbia Certificate of Pending Litigation Form 31

If you are filing a lawsuit for a lien or other legal action with respect to real property, you must obtain a Certificate of Pending Litigation from the Supreme Court of British Columbia.

  • Once the certificate has been obtained it must be filed against title to the property.
  • The Certificate is required under Section 215(1) of the BC Land Title Act.
