Q. What laws protect landlords and tenants in Victoria?

A.  Residential rental relationships in Victoria are governed by the Residential Tenancies Act 1997. This legislation sets out the legal rights, obligations and responsibilities of VIC landlords and renters.

The Act applies to the following types of tenancies:

  • Standard private and public housing rentals where a renter (tenant) leases a general property or house to use as a primary home
  • Rooming house occupancy arrangements where a resident rents a single room within a rooming house and shares common areas (like kitchens or bathrooms) with other people
  • Caravan park residency agreements for people renting a movable dwelling inside a caravan park
  • Specialized site agreements for site tenants who own their own movable dwelling or transportable home but rent the underlying land plot (site) in a residential park or village
  • Tenancies providing specific regulated housing for people with disabilities

The Act DOES NOT apply to the following types of tenancies:

Q. Does a tenancy agreement need to be in writing to be legally valid?

A. Victoria legislation does not specifically require the agreement to be in writing, however, the Act does state that the prescribed form must be used if entering into a written rental agreement. A written agreement is always preferable because it provides important evidence of the agreed rental terms and can help avoid future disputes.

Q. How often can a landlord increase the rent under the Act?

A. Rental providers in Victoria cannot increase the rent during a fixed term tenancy, unless the tenancy agreement specifically allows for an increase.The agreement must also state how the increase will be calculated.

For a periodic tenancy, in most cases the rent cannot be increased more often than once in each 12-month period. The landlord must give at least 90 days' prior notice before the rent increase takes effect. (For periodic rentals that started before 19 June 2019, the rent can't be increased more than once in a 6-month period.)
