Under Georgia law, a commercial landlord has two options for removing a business tenant who has defaulted under their lease. The landlord can bring an eviction or dispossessory proceeding to evict the tenant and remove all of its property.
Alternatively, the landlord can file an action for distraint and try to obtain a distress warrant, which would allow the landlord to take possession of the tenant's goods in the premises and sell them to recover any outstanding rent and other costs incurred in the process.
