A. The rights and obligations of tenants and landlords in Tasmania are set out in the Residential Tenancy Act 1997.
The Act does NOT cover sub-leases, boarders, holiday or hotel accommodations, or properties let under the Retirement Villages Act 2004.
Q. Does the tenancy agreement need to be in writing?
A. Tasmanian legislation does not require that the tenancy agreement be in writing. The lease or tenancy agreement can be in writing, verbal or a combination of both. However, as best protection for both parties and for purposes of clarity, a written agreement is recommended. A written agreement is always preferable because it provides important evidence of the agreed rental terms and can help avoid future disputes.
Q. In what types of situations can a TAS landlord evict a tenant?
A. Under the Residential Tenancy Act 1997, a landlord must have a specific, valid legal ground to terminate the tenancy agreement and evict the tenant, but only after a written Notice to Vacate has been served on the tenant in compliance with the Act.
If the tenant fails to pay the rent or breaches the tenancy agreement, the landlord must give at least 14 clear days' written notice. If the tenant cures the breach within the 14-day period, the notice becomes void, except for repeated rent arrears violations.
If the tenant causes serious disturbances, damage, or acts of violence, 14 clear days' written notice to vacate is required in order to end the tenancy and evict the tenant.
