Why should I make a power of attorney?
Having a power of attorney in place means that if you are unable to make decisions or manage your financial affairs, someone you trust will be able to manage things for you. You must be mentally competent at the time you sign a power of attorney.
When does the power of attorney become effective?
This Power of Attorney is effective immediately and remains in effect even if you become disabled or incompetent. However, you still have the right to make your own decisions and manage your own affairs so long as you are able to do so.
What powers will my attorney-in-fact have?
At your discretion, you may grant your attorney-in-fact the power to deal with:
- your real estate property,
- banking and financial transactions,
- stocks and bonds,
- personal property,
- insurance,
- pension and employment benefits,
- tax and legal matters,
- your business affairs and operations.
Does the power of attorney also include health care decisions?
No. This Power of Attorney form cannot be used to delegate the authority to make health care or other medical decisions for you. For that, you will need to make an advance directive or health care power of attorney.
