Who Can File a Mechanics Lien Under Hawaii Law?
Hawaii law grants the right to file a mechanics lien to a wide range of construction professionals and participants. This includes general contractors, subcontractors, sub-subcontractors, suppliers, laborers, architects, engineers, and other design professionals. However, for architects and design professionals, lien rights are only applicable if their work is actually incorporated into the construction project.
It is important to note that if Hawaii state law requires a party to be licensed to conduct business, any unlicensed party will not be entitled to lien rights.
Mechanics Lien Filing Deadlines
To preserve lien rights, it is essential to adhere to the strict deadlines set by Hawaii law. A mechanics lien must be filed within 45 days of the completion of the improvements to the property.
If a Notice of Completion is filed, the date on this notice is considered the official completion date for calculating the 45-day filing window.
In the absence of a Notice of Completion, the project is deemed complete one year after its substantial completion, and this date is used to determine the filing deadline.
Hawaii Conditional Waiver and Release of Lien - Final Payment
Have you received final payment for your work on a construction job in Hawaii? It's time to provide the property owner with a Conditional Waiver and Release of Lien on Final Payment.
This document acknowledges that, upon receipt and clearance of the final payment, all of the contractor’s lien rights and claims related to the labor, materials, or equipment supplied for the property's improvements are relinquished.
Effectiveness of the Waiver
The waiver and release only become effective once the payment has been received and has cleared the owner’s bank. Until this condition is met, the contractor's rights to claim a lien against the property remain intact. Once the payment has cleared, all such rights and claims are fully waived and released.
