Eligibility for Filing a Mechanics Lien in Massachusetts
In Massachusetts, any party that provides labour or materials for the construction or improvement of a structure, or the underlying land, is eligible to file a mechanics lien. This includes general contractors, subcontractors, material and service providers, equipment lessors, and design professionals. However, suppliers to suppliers, parties lower than sub-subcontractors, and sellers of tools and equipment are not entitled to mechanics lien protection.
Filing Deadlines for Mechanics Liens
The deadline for filing a mechanics lien (Statement of Account) in Massachusetts is determined by the earliest of the following dates:
- 90 days after the Notice of Substantial Completion is recorded,
- 120 days after the Notice of Termination is recorded, or
- 120 days after the last furnishing of labour or materials.
Notably, a lien may be filed before the Notice of Substantial Completion or Notice of Termination is filed.
