  • When you serve legal documents on someone within Ontario, you need to prove that they have been served by making an Affidavit of Service which must then be filed with the appropriate court. This is required in all legal proceedings, landlord-tenant disputes and evictions, foreclosures and repossessions.
  • The person who served the documents on the recipient swears or affirms that the documents listed in the Affidavit were properly served on the party to whom they were addressed.
  • The form includes a variety of different methods by which the documents may have been served, so the process server can just indicate which method was used.
  • The Affidavit must be executed and given in front of an officer of the court, such as a Commissioner of Oaths or a Notary Public.
