State Law Governing Lien Waivers
North Carolina law does prescribe any statutory forms that lien waivers must adhere to. Both conditional and unconditional waivers are allowed.
Lien rights cannot be waived "in anticipation of and in consideration for the awarding of a contract". However, State law does allow waiving lien rights prior to payment, as long as the waiver is not given as consideration to be awarded the contract.
