State Law Governing Lien Waivers
Washington law does not require a statutory form for lien waivers. Both conditional and unconditional lien waivers are allowed. State lien law further provides that lien waivers must be exchanged upon payment only if the owner requests it.
Parties are permitted to waive their lien rights in the contract prior to commencement of work, and lien rights can even be waived prior to payment.
