Scope of Waiver and Release

The Waiver and Release authorizes a release of all lien rights or claims for payment which the contractor may have for labor, materials or equipment supplied to the property, up to the date of the progress payment.

This is an unconditional waiver and release. Don't use this waiver and release unless the check for the payment has actually cleared. If not, use a Conditional Waiver and Release instead.

Warranty of Payment

The claimant warrants that all invoices for labor, materials and services on the project have been paid, or will be paid from the proceeds of the progress payment.
