What is a quitclaim deed?
A quitclaim deed is a legal instrument through which the property owner (transferor) conveys their ownership of a property to a different owner (transferee). The transferor does not offer any warranties regarding the property’s title, condition, or any other aspect. A quitclaim deed simply transfers whatever interest the transferor holds at the time of execution. It is particularly useful when the parties do not require extensive guarantees.
How would this quitclaim deed be used?
Arizona is a community property state. The transferees have to option to take title in one of three ways:
- as joint tenants, with rights of survivorship, which means that if one of them dies, title to the property passes to the surviving joint tenant, or
- as community property with rights of survivorship, or
- as community property without rights of survivorship.
To accommodate the second two options above, this template includes a Community Property Agreement to be signed by the transferees where applicable.
