What is a special warranty deed?

special warranty deed is a means of conveying title to a property, under which the seller (called the grantor) warrants or guarantees the title only against title defects that arose during his/her ownership of the property, but not against title defects existing before that time.

Special warranty deeds are commonly used:

  • by executors and trustees to transfer estate property to a beneficiary,
  • in commercial transactions, and
  • in foreclosures.

Exceptions

The grantor transfers title to the buyer (called the grantee) subject to current taxes and assessments, easements, encumbrances, liens and liabilities.

Waiver of Homestead

The grantor waives and releases any homestead exemption rights in the property.
