When a License for Use / Release is Needed
A release from the copyright holder is necessary whenever copyrighted materials are going to be visible onscreen. This includes artwork, photos, drawings, and printed works or portions thereof (such as quotes).
Scope of License
The copyright holder grants the producer an exclusive perpetual universal license to use the copyrighted material in connection with the motion picture and any derivative works, ancillary uses (such as promotional use), and merchandising.
The producer is not obligated to use the material.
Warranty of Copyright Holder
The copyright holder warrants that he/she has the right to grant the license, and will indemnify the producer against any claims or damages arising from its use of the material.
Release
The copyright holder releases the producer from any claims that may arise for libel, defamation, copyright infringement, or otherwise.
