Michigan Notice of Commencement (Non-Residential Property)
If you are doing improvements to a non-residential property in Michigan, you must give notice to all interested parties by serving them with this Notice of Commencement form.

State Law Governing Lien Waivers
Michigan law sets out the language that must be contained in lien waivers for progress payments and final payments. Both conditional and unconditional waivers are allowed.
Lien rights cannot be waived in the contract. Lien rights can only be waived to the extent of payment for labor and/or materials furnished.

Michigan Full Conditional Waiver of Lien
Provide the owner with this Full Conditional Waiver of Lien after you receive final payment for your work or materials on a Michigan construction job.
- This is the statutory form required by S. 570.115.9(d) of the Act.
- The waiver is only effective on the condition that the contractor actually receives payment from the owner, lessee or designee for labor, materials or equipment supplied for improvements to the owner's property.
- Only use this form for final payment, not for progress payments.
- The law prohibits anyone from requesting a waiver in advance of the work being done or the materials being provided.
