Lead Paint and Radon Disclosures | USA

Landlords are required to attach these lead-based paint and radon gas disclosures to leases and rental agreements for residential tenancies in the United States.

  • The first disclosure statement covers the presence of lead-based paint and/or lead-based paint hazards within the rental premises and must be attached to all rental agreements and leases for properties built before 1978.
  • The second disclosure is for the presence of radon gas. Some states have laws requiring radon gas disclosure, but whether or not your state requires this disclosure, if the rental property is located in an area known to have radon problems and you fail to test for radon or warn your tenants, you could be sued if the tenants suffer any harm as a result.
  • Both parties must sign the disclosure statements, otherwise the rental agreement / lease will terminate.
