California Vehicle Storage Agreement

Introduction

This template is designed to help prepare customer contracts for vehicle storage facilities located in California. It provides a quick and easy framework for both facility operators and vehicle owners to formalize their storage arrangements.

Default in Payment

If the vehicle owner fails to pay the required storage fees or any other amounts due, the stored vehicle may become subject to lien sale proceedings. This means the facility has the right to initiate a legal process to recover unpaid fees by selling the vehicle.

Facility Liability

The liability of the storage facility is limited to the lesser of two amounts: the fair retail used vehicle value at the date of the agreement or the value declared by the owner. This limitation ensures that the facility's responsibility for loss or damage does not exceed a reasonable threshold.

Security Provisions

The storage facility is responsible for providing adequate security for vehicles stored on the premises. Security measures may include video monitoring systems, patrol dogs, motion sensors, and alarms to help protect against theft and damage.

Permitted Uses

This agreement covers vehicle storage only. Vehicle owners are strictly prohibited from repairing, servicing, or maintaining their vehicles on facility grounds. The facility is intended solely for storage purposes.

Jurisdiction

This agreement is intended for use exclusively within the State of California and should not be applied outside of this jurisdiction.
