State Law Governing Lien Waivers

Montana does not have any prescribed statutory form that lien waivers must adhere to. Both conditional and unconditional waivers are allowed, but lien rights cannot be waived prior to payment being received, or against a payment bond.

Lien rights cannot be waived in the contract.
