State Law Governing Lien Waivers

New York law does not specify a statutory form for lien waivers. Both conditional and unconditional lien waivers are allowed, however, unconditional waivers must only be exchanged after payment, to protect contractors, subs and suppliers.

State law prohibits a party waiving its lien rights in the contract. Additionally, a party cannot waive lien rights prior to receiving payment, unless the lien is subordinated.
