State Law Governing Lien Waivers

Texas law requires a statutory form for each type of lien waiver. Both conditional and unconditional lien waivers are allowed, but unconditional waivers can only be given after payment is received.

State law also prohibits a party from waiving its lien rights in the contract.

Texas Affidavit of Completion

Texas home owners, if you have just completed construction on your home, you must swear an Affidavit of Completion under Section 53.106 of the Texas Property Code.
