Texas Final Bills Paid Affidavit by Contractor

Texas home owners, if you have just completed construction on your home, you must swear an Affidavit of Completion under Section 53.106 of the Texas Property Code.

• The Affidavit of Completion must be served on the contractor and each sub-trade or supplier that has sent you a notice of lien liability.

Legal Basis for Affidavit

The Affidavit Claiming Lien is made pursuant to Chapter 53 of the Texas Property Code. The Affidavit is NOT a lien claim, it is a sworn statement that the party making the Affidavit has a right to claim a lien for labor, services or equipment provided for a construction or improvement project.

The lien claimant (a contractor, subcontractor or supplier) makes the Affidavit to give evidence as to the validity of their lien claim.
