When would this Affidavit of Abandonment form be used?
The Affidavit of Abandonment and Intent to Recommence Construction would be used by a property owner in Florida when work on a construction project has ceased or the direct contract has been terminated before the work was completed, and the owner wants to resume the project.
Florida Statute ยง 713.07(4) sets out the procedure, which is primarily a means for the owner to protect themselves from lien claims that arose prior to the project being stopped.
Contents of Affidavit
The property owner can make and file the Affidavit with the clerk's office, to inform all interested parties that the owner intends to recommence construction and that all lienors who gave notice have been paid in full except for those that are listed.
Priority of Liens
Thirty days after the affidavit is recorded, the rights of any person that acquires a lien interest in the property will rank in priority to any lien on the prior construction, unless such lienor records a claim of lien within the 30-day window. Any liens previously recorded would need to be re-recorded within the 30-day period to preserve their priority.
Service of the Affidavit
All lienors listed in the document must be served with a copy of the Affidavit. The template form includes a Certificate of Delivery, which can be used to record the details of how each lienor was served.
