Georgia Patient Consent and Medical Lien Agreement

Make sure injury patients pay their bills by having them sign this Georgia Patient Consent and Medical Lien Agreement.

Why should I use a Medical Lien Agreement?

medical lien (also called a doctor's lien) ensures that your bills will be paid from any amounts eventually recovered by the patient. This gives medical service providers the flexibility to provide those services without up-front billing, knowing that the lien will be paid from the recovery proceeds.

Lien Rights

The medical provider has an irrevocable lien over any amounts awarded to the patient. The patient's attorney is directed to satisfy the lien out of the settlement funds. Notwithstanding any settlement of the claim, the patient remains personally responsible for paying the fees.

Patient Consent

The patient authorizes the medical practitioner to release any information about the accident or injury being treated for purposes of the patient's injury claim.

Format and Scope of Use

This is a reusable legal form in MS Word format. Once you've purchased it, you can use it as often as you like. The template can be customized for your specific business needs.

This Patient Consent and Medical Lien Agreement is intended for use only in the State of Georgia.

Georgia Lien Waiver and Release Forms

GA contractors, release all or a portion of your lien against real property with this package of Georgia Lien Waiver and Release forms.

State Law Regarding Lien Waivers

Georgia law mandates specific statutory forms for lien waivers on construction projects. Conditional waivers are only effective for 90 days, after which they become unconditional waivers unless an Affidavit of Nonpayment is filed within that 90-day period.

In order to be legally valid, lien waivers must be given under seal and must be witnessed. If an Affidavit of Nonpayment is filed, it must be notarized.

A party cannot waive its lien rights in the contract, before work commences or services or materials are furnished. Because of the 90-day period for conditional waivers, payment must be exchanged within the 90 days. If no Affidavit of Nonpayment is filed, it is assumed payment has been made and the waiver becomes unconditional.

What is included in this Lien Waiver Package

This package contains the following forms:

  • Waiver and Release of Lien and Payment Bond Rights upon Interim Payment - statutory form
  • Waiver and Release of Lien and Payment Bond Rights upon Final Payment - statutory form
  • Optional Notary Acknowledgement (if Affidavit of Nonpayment is filed)
  • Optional Job Completion Certificate form.
