Purpose of Waiver and Release

This Waiver and Release authorizes a full and complete release of any lien rights or claims for payment which the claimant may have against the owner's property for labor, services and/or materials furnished for construction or improvements to the property, up to the date of a specific progress payment.

This is an unconditional waiver and release. It should only be used when the progress payment clears.

State Law Governing Lien Waivers

Texas law requires a statutory form for each type of lien waiver. Both conditional and unconditional lien waivers are allowed, but unconditional waivers can only be given after payment is received.

State law also prohibits a party from waiving its lien rights in the contract.
