Affidavits

An affidavit is a written statement of facts confirmed by the oath of the party making the affidavit, known as the affiant. This statement is made in front of a lawyer, notary public, commissioner for oaths, or another officer who is authorized to administer oaths. The affidavit serves as a formal means to present factual information in a legal context, ensuring that the facts stated are sworn to be true by the affiant.

Statutory Declarations

A statutory declaration closely resembles an affidavit, but instead of being sworn, it is affirmed by the person making it, referred to as the declarant. This affirmation must be witnessed by an authorized official such as a justice of the peace, commissioner, notary public, or lawyer. Statutory declarations provide a legally recognized way for individuals to affirm the truth of statements without taking an oath.

Acknowledgements

An acknowledgement is a formal declaration made before an authorized person, such as a notary public, which confirms that the document to which it is attached is being signed as a free act and deed by the person signing. This process helps to ensure the authenticity and voluntariness of the signature on legal documents.
