A mechanics’ liens can be filed under the Builders' Lien Act of New Brunswick by any person or company who performs work or furnishes services or materials for improvements to a project / property. Your lien rights come into existence at the time you first performed the work or provided the services or materials to a job site.
Once a lien is filed against title, no funds or draws can be released and the existence of the lien can prevent the sale or transfer of the property.
A lien for wages and services must be filed within 30 days from the date of last work. A lien for materials must be filed within 60 days from the date of last furnishing of materials.
