North Dakota Requirements for Return of Security Deposits

The tenant's security deposit and an itemized list of deductions must be returned within 30 days of the move-out date. The landlord can deduct for damages to the property or unpaid rent but not for normal wear and tear.

Under a fixed term lease, the landlord can keep the full security deposit until the end of the lease term, even if one tenant moves out early. For leases longer than nine months, the landlord must pay interest on the security deposit.

The landlord cannot charge a pet deposit for a service animal but can require the tenant to provide proof of medical need.

Purpose of the Security Deposit Statement Form

The Security Deposit Statement sets out the amount of the original security deposit and any additional deposits, less any deductions being made for unpaid rent or utilities, cleaning charges, repair charges, or other allowable deductions.

The amount of the refund or balance owing is calculated by deducting the amounts claimed from the total of the security deposit.

When to Use the Form

The Security Deposit Statement should be sent to the tenant after the end of the tenancy, along with the return of the security deposit funds or, alternatively, a demand for payment of any balance owing for claims.
