State Law Regarding Lien Waivers

Idaho law does not have specific statutory forms for lien waivers. The lien waiver must clearly state that the lien claimant intends to waive their lien rights in exchange for payment.

State law also prohibits a party from waiving its lien rights prior to providing labor or materials on a project.

Failure to do either within the 30-day period will result in the lien being forfeited.

Conditional Nature of the Waiver

The waiver of lien rights is strictly conditional. The contractor’s rights are waived only if and when the progress payment from the customer has been successfully processed and cleared by the bank. This condition ensures that contractors are protected from waiving their rights before receiving actual payment.
