State Law Governing Lien Waivers

Nebraska law does not contain regulations or provisions about the form, content or language of the forms to be used. If the language used in the form is not clear, the court will find in favor of the property owner in the event of a dispute.

Purpose and Function

The primary function of this waiver and release is to authorize the release of any lien rights or claims for payment that the contractor may have against the owner's property. However, this release is conditional: it becomes effective only after the final payment from the customer has cleared the bank. This ensures that contractors are protected until they actually receive their funds.

Notice of Completion
