State Law Governing Lien Waivers
Oregon law does not specify a statutory form for lien waivers. Both conditional and unconditional lien waivers are allowed.
State law requires all parties with lien rights to deliver a Notice of Right to File Lien to the property owner, to protect against non-payment. This notice should be served on the owner within 8 days of supplying labor or materials.
There is nothing contained in Oregon statutes that prohibits a party from waiving its lien rights in the contract. Additionally, a party can waive its lien rights prior to receiving payment.
