Relationship of the Parties
The licensed agent (licensee) is being retained as an independent contractor, not as an employee. The licensee will be paid compensation at the brokerage's current rates, but will be responsible for remitting its own taxes and other required deductions.
Services Provided by Licensed Agent
The licensee will provide a variety of services under the contract, as required by the brokerage, including all client services necessary for buying or selling properties, and rental property management services to residential landlord clients.
All services undertaken and performed by the licensee will be done in the name of the brokerage. The licensee is not authorized to give legal or tax advice.
Brokerage's Obligations
The brokerage will carry worker's compensation and vehicle insurance for the licensee. The brokerage will also maintain professional liability and E&OE insurance to cover any claims arising from the licensee's actions, omissions or negligence.
The brokerage is not required to provide an office or other workspace for the licensee, or to cover any of the licensee's expenses.
Indemnification
Each party agrees to indemnify and hold the other party harmless against all claims, losses and damages arising out of the provision of services under the agreement.
