What is the purpose of the Notice of Lien form?
Under the provisions of ORS 87.555 (Hospitals, physicians, physician assistants and nurse practitioners as lien claimants), a medical service provider can claim a lien for any unpaid amount for hospitalization or medical treatments rendered to an injury patient, if that patient makes a damages claim against the person or party that caused the injury.
The lien is claimed against any judgment or settlement amount awarded to the injured person.
In order to perfect the lien, the lien claimant must file a Notice of Lien not later than thirty (30) days after the patient has been discharged from the hospital.
Who can use this Notice of Lien form?
Pursuant to Oregon State laws, the following parties have statutory lien rights for medical services rendered to an injury victim:

- an owner / operator of a hospital
- physicians
- physician assistants
- nurse practitioners

State Law Governing Lien Waivers
Oregon law does not specify a statutory form for lien waivers. Both conditional and unconditional lien waivers are allowed.
State law requires all parties with lien rights to deliver a Notice of Right to File Lien to the property owner, to protect against non-payment. This notice should be served on the owner within 8 days of supplying labor or materials.
There is nothing contained in Oregon statutes that prohibits a party from waiving its lien rights in the contract. Additionally, a party can waive its lien rights prior to receiving payment.
