State Law Governing Lien Waivers

Utah State law requires a statutory form for each type of lien waiver. There are two types of lien waivers allowed under current legislation - one for final payments and one for progress payments.

The Waiver and Release only becomes effective once final payment has been received and the payment has cleared the claimant's bank.

Commonwealth Law Governing Lien Waivers

Virginia law does not require a statutory form for lien waivers. Both conditional and unconditional lien waivers are allowed. The waiver of rights must be supported by sufficient consideration. 

Parties cannot waive their lien rights in the contract, however, lien rights can be waived prior to payment.

Laborers must have a valid license or certificate in order to be able to claim a lien.
