State Law Regarding Lien Waivers
Georgia law mandates specific statutory forms for lien waivers on construction projects. Conditional waivers are only effective for 90 days, after which they become unconditional waivers unless an Affidavit of Nonpayment is filed within that 90-day period.
In order to be legally valid, lien waivers must be given under seal and must be witnessed. If an Affidavit of Nonpayment is filed, it must be notarized.
A party cannot waive its lien rights in the contract, before work commences or services or materials are furnished. Because of the 90-day period for conditional waivers, payment must be exchanged within the 90 days. If no Affidavit of Nonpayment is filed, it is assumed payment has been made and the waiver becomes unconditional.
