State Law Governing Lien Waivers

Minnesota does not require a statutory form of lien waiver. Both conditional and unconditional waivers are allowed, but only after payment is received.

Lien rights cannot be waived in the contract. Lien rights cannot be waived against payment bonds or before payment.

Minnesota law also requires the owner or other party that is making payments to provide monthly progress payments based on estimates of the work completed, unless otherwise specified in the contract.
