This document provides Oregon landlords with a legal process to address situations where an unauthorized person is residing in a tenant’s rental unit without your permission. If you discover that someone who is not a legal tenant is occupying your property, you may initiate the eviction process by serving a 24 Hour Termination Notice.

Purpose of the Notice

The 24 Hour Termination Notice is specifically intended for use when an individual is found living in a rental unit without authorization according to the terms of the rental agreement. The notice must be served to any occupant who is not recognized as a legal tenant.

  • The Notice informs the unauthorized occupant that their presence in the rental unit is a violation of the rental agreement.

Oregon Notice for Cause Termination

Oregon landlords, do you have legitimate grounds for terminating your tenant's rental agreement? You must first serve the tenant with a Notice for Cause Termination.

Purpose and Process of Notice

The Notice for Cause Termination serves to inform the tenant that they have violated the terms of the rental agreement. It specifies the number of days the tenant has to correct the issue.

If the tenant fails to remedy the violation within the allotted time, the rental agreement will be terminated, and the tenant must vacate the property.

A Service of Notice form is provided to document the details regarding how the Notice was served to the tenant.

PEI Notice of Intention to Retain Security Deposit

If you plan to keep all or part of your tenant's security deposit, you must serve them with this Notice of Intention to Retain Security Deposit under the PEI Rental of Residential Property Act.

  • The Notice sets out how much of the deposit will be kept by the landlord, and for what reason(s).
  • You must also inform the tenant how much interest accrued on the deposit, and how much they are getting back.
  • The balance of the security deposit must be included with the Notice.

PEI Notice of Rent Increase

Before you can raise the rent on a rental unit in PEI, you must serve your tenant with this Form 8 Tenant Notice of Annual Allowable Rent Increase.

  • The landlord must inform the tenant:
    • how much the increase is,
    • what the new rent will be,
    • how much of a percentage increase this is,
    • what the maximum allowable increase is,
    • the date that the rent for the property was last increased.
