Types of Liens Under Texas Law

Texas law recognizes two main types of liens: the constitutional lien and the statutory lien.

  • Constitutional Lien: This type of lien arises automatically for any party in a direct contractual relationship (privity of contract) with the property owner who provides goods used in improving the property.
  • Statutory Lien: Subcontractors and others who are not in direct contract with the property owner do not have a constitutional lien. Instead, they must file a lien affidavit under Chapter 53 of the Texas Property Code to create a statutory lien and secure their lien rights.

  • Non-Residential Projects. Subs and suppliers who have directly contracted with the prime contractor must give notice by the 15th day of the 3rd month following each month work was performed and unpaid.
